INVESTIGATIONS

Buckner is adept at resolving issues that require in-depth investigation or fact-finding. Our Internal Investigation Team includes an attorney who possesses a range of experience and skills, including: a former licensed private investigator; and author of Athletics Investigation Handbook: A Guide for Institutions and Involved Parties During the NCAA Enforcement Process, the leading publication on conducting and managing NCAA enforcement investigations. We have conducted investigations and represented clients in a range of inquiries including: fraud; student-athlete abuse by coaches; illicit sports wagering; non-compliance with government rules and regulations; non-compliance with NCAA, NAIA and NCJAA legislation; sexual harassment; ethical misconduct; due-diligence; and non-compliance with organizational rules and regulations.


TITLE IX AND GENDER-EQUITY

A unique approach is needed to ensure educational clients meet Title IX/gender-equity laws, regulations and standards. We use a four-phase Title IX/gender-equity audit—a pre-visit assessment; an online survey; a four-day campus visit; and a post-visit assessment—which gathers the necessary data concerning gender-equity and the identification of gender-equity concerns. Our audit services provide clients with a process that allows a systematic review of critical indicators of the progress toward the achievement of the desired outcomes of a collaborative gender-equity plan.


COMPLIANCE AND ETHICS

We are available to assist you with developing proactive solutions to address an organization's most pressing compliance and ethics needs. In particular, our experienced attorneys, consultants and affiliated professionals can help you with complying with government regulations by evaluating, auditing or reviewing your organization's operations and processes, as well as developing effective compliance and ethics systems.
 


UNIVERSITY AND HIGH SCHOOL: ELIGIBILITY, TRANSFERS AND WAIVERS

Buckner is available to assist colleges, universities, high schools, prep schools, parents, parent groups and student-athletes with addressing eligibility-related issues. For example, we represent student-athletes who have been denied participation in a sport, contest or post-season competition by a school or the applicable interscholastic/interscholastic athletics association. We also represent schools who seek the equitable resolution of eligibility-related issues involving transfers, alleged improper recruiting or club-sports participation.


LITIGATION

As the world continues to globalize, innovate and automate, individuals, businesses and other organizations need a law firm that can handle complex matters involving several practice areas in federal and state courts. Buckner’s litigation practice meets that challenge. We demonstrate a comprehensive command of a case from the start, as well as the enthusiasm to pursue the most difficult cases. We provide our clients with litigation services in the following areas: appeals; general commercial litigation; consumer defense (credit and charge card disputes, vehicle repossessions); employment discrimination; internal investigations; landlord-tenant; and product liability.

Buckner can work with you to develop and conduct education and training seminars and workshops that produce measurable and dramatic results for an athletics department. Our advisors will analyze your department to produce creative presentations and materials that are informative and useful. For example, our professionals have provided or developed seminars and workshops in a variety of areas and topics, including: academic-fraud; rules-compliance with interscholastic athletics regulations; ethics; internal investigation techniques; leadership and teamwork; process improvement; teaching and coaching techniques and strategies for high-school professionals; and diversity education and training.
